This note analyses a recent case of the English Court of Appeal in which the applicant, R.G., a gay, H.I.V. positive Colombian claimed asylum on grounds of persecution due to his sexuality. Both the Asylum and Immigration Tribunal and the Court of Appeal rejected R.G.’s claim for asylum. The Court of Appeal’s first and most significant reason was that the alleged persecution was not sufficiently serious or life threatening, since R.G. had not suffered actual physical violence throughout the 13 years (...) that he had lived as a closeted gay man in Colombia. Secondly, the court considered the real reason for R.G.’s seeking asylum was his desire to access free health care in order to manage his H.I.V. His allegations of persecution on the grounds of sexuality were viewed as a sham. This note is critical of the approach taken by the Court, which, it is argued, displays an insensitivity to the complexity of sexual identity and its performance and has the effect of perpetuating and legitimating discrimination against lesbians and gay men. The author discusses the contributions of grounded theory and grounded action to the development of a new, and evolutionary, theoretical framework for understanding diversity as a complex phenomenon. She discusses the work of Thomas and Gregory as pioneers in expanding the conceptualization of diversity, arguing that this new understanding increases the potential for creative action in systems.

Much of Halford et al.'s discussion of vector models for representing relations concerns the perceived inadequacies of alternative methods with respect to chunking, binding, systematicity, and resource requirements. Vector-based models for storing relations are in their infancy, however, and the relative merits of different schemes are not so clearly in favor of their STAR scheme as Halford et al. portray.

Peroxisomal matrix proteins are synthesized on cytosolic ribosomes and rapidly transported into the organelle by a complex machinery. The data gathered in recent years suggest that this machinery operates through a syringe-like mechanism, in which the shuttling receptor PEX5 − the “plunger” − pushes a newly synthesized protein all the way through a peroxisomal transmembrane protein complex − the “barrel” − into the matrix of the organelle. Notably, insertion of cargo-loaded receptor into the “barrel” is an ATP-independent process, whereas extraction (...) of the receptor back into the cytosol requires its monoubiquitination and the action of ATP-dependent mechanoenzymes. Here, we review the main data behind this model. The peroxin PEX5 is the peroxisomal matrix protein receptor. It shuttles between the cytosol and the organelle membrane, where it gets inserted into the docking/translocation module, thus pushing the cargo-protein into the peroxisome lumen. Resetting the system involves PEX5 monoubiquitination and its extraction from the membrane by the AAA-ATPases, PEX1/PEX6. (shrink)

Ribonucleotide reductase (RNR) catalyzes the rate limiting step in the production of deoxyribonucleotides needed for DNA synthesis. In addition to the well documented allosteric regulation, the synthesis of the enzyme is also tightly regulated at the level of transcription. mRNAs for both subunits are cell cycle regulated and inducible by DNA damage in all organisms examined, including E. coli, S. cerevisiae and H. sapiens. This DNA damage regulation is thought to provide a metabolic state that facilitates DNA replicational repair processes. (...) S. cerevisiae also encodes a second large subunit gene, RNR3, that is expressed only in the presence of DNA damage. Genetic analysis of the DNA damage response in S. cerevisiae has shown that RNR expression is under both positive and negative control. Among mutants constitutive for RNR expression are the general transcriptional repression genes, SSN6 and TUP1. Mutations in POL1 and POL3 also activate RNR expression, indicating that the DNA damage sensory network may respond directly to blocks in DNA synthesis. A protein kinase, Dun1, has been identified that controls inducibility of RNR1, RNR2 and RNR3 in response to DNA damage and replication blocks. This result suggests that the RNR genes in S. cerevisiae form a regulon that is coordinately regulated by protein phosphorylation in response to DNA damage. (shrink)

Regulatory authorities have advised smokers who would not or could not quit smoking to switch to lower tar cigarettes. Smoking such cigarettes was seen as a means of reducing the harm caused by smoking, but not as offering a ‘safe’ smoking option. Correspondingly manufacturers have been required to place tar and nicotine information on packet labels and/or advertisements. This paper explores the possibility that the conventional format for conveying tar and nicotine information could be responsible for the belief, held by (...) a significant proportion of smokers, that some brands of lower tar cigarettes are absolutely ‘safe’. To deal with this situation it is suggested that changes should be made to health warnings, and tar and nicotine communications. Proposed changes to the latter are evaluated in terms of their ethical and public health implications. The authors conclude that brand specific warnings and a classification of cigarettes as either ‘Very Dangerous’ or ‘Dangerous’, is best suited to reconciling consumer needs for information with the public health objectives of reducing the harm caused by smoking. Ethics, communication skills, and the law ('practice skills') are important in all aspects of modern health care. Doctors and nurses must be sensitive to the ethical aspects of their work and understand the legal framework within which clinical decisions are made. Well developed skills of communication, with patients, their relatives and other members of the clinical team, are a key feature of good clinical practice Until recently, the important of practice skills has been relatively neglected in health care education. This (...) situation is changing. The UK General Medical Council, for example, has recently identified three aspects as part of the core of the medical course, and the move to degree courses in nursing has led to an increasing focus of practice skills in nurse education. The Oxford Practice Skills Project (OPSP) team have developed a course, within the University of Oxford Clinical School, which covers the teaching of practice skills in an integrated manner. This course is widely recognized as one of the most systematic developments of education in these areas. This manual describes the OPSP course in detail and provides teaching materials. Although developed initially for medical students, it should be helpful to all those involved in teaching ethics, communication skills, and law in health care. To what extent should scientists, doctors and the community be constrained in their decision-making by a duty to posterity? How should we as a community balance our desire to benefit the present generation against the need not to irretrievably harm our successors? These questions are discussed with particular reference to genetic research and treatment that may have great potential for people suffering from genetic disease but may cause inherited changes in future generations, either deliberately or inadvertently. We conclude that the (...) community should take account of the interests of its successors but this should not immobilise us in the decisions we make for the present. (shrink)

Tuberculosis (TB) is one of the world’s leading causes of death due to infection and efforts to control TB would be substantially aided by the availability of an improved TB vaccine. There are currently nine new TB vaccines in clinical development, and the first efficacy trials are due to commence in 2009. There are many complex ethical issues which arise at all stages of TB vaccine development, from the need to conduct trials in developing countries to informed consent and the (...) process of ethical review. While it is important that these issues are discussed, it may also be timely to consider the challenges which may arise if a vaccine in clinical development proves to be highly effective. We examine a number of scenarios where decisions on the deployment of a new TB vaccine may impact on the rights and liberty of the individual. (shrink)

In June 2021, Missouri passed the “Second Amendment Preservation Act” (SAPA). Though SAPA passed easily and had gubernatorial support, many Missouri law enforcement agencies, including the Missouri Sheriff’s Association, oppose it. Missing from this policy conversation, and deserving of analysis, is the voice of Missouri citizens. Using qualitative interview data and survey data, we explored what if anything Missouri gun owners knew about SAPA and what they perceived its effects would be on gun-related murders, suicides, gun thefts, and mass shootings. (...) Most Missouri gun owners had not heard about SAPA and were ambivalent about its potential effect on gun safety outcomes. Our findings also indicate that respondents’ attitudes toward SAPA and the impact of such policy on safety is driven by gun ownership (i.e., primary versus living in a household with firearms), partisan identification, and attitudes toward government firearm regulation. We argue that two main accounts of hypocrisy— the deception-based and the moral-non-seriousness-based account—fail to capture a specific kind of hypocrite who is morally serious and sincere "all the way down." The kind of hypocrisy exemplified by this hypocrite is irreducible to deception, self-deception or a lack of moral seriousness. We call this elusive and peculiar kind of hypocrisy, pure hypocrisy. We articulate the characteristics of pure hypocrisy and describe the moral psychology of two kinds of pure hypocrites.

The editors of the JRE solicited short essays on the COVID‐19 pandemic from a group of scholars of religious ethics that reflected on how the field might help them make sense of the complex religious, cultural, ethical, and political implications of the pandemic, and on how the pandemic might shape the future of religious ethics.

A primary aim of our research was to provide empirical grounds on which to stimulate discussion about the nature of decision-making capacity (DMC). Whiting criticizes in particular the concept (...) of 'pathological values' that we suggested might be relevant in the assessment of DMC and in the related issue of deciding when a patient's refusal of beneficial treatment should be overridden.Whiting's central concern is with DMC. Whiting argues that the absence of pathological values should not be a criterion for DMC. We are unclear whether he is also arguing that pathological values do not provide a reason of any kind for overriding treatment refusal. At the end of the paper he writes: "we cannot justify compulsory treatment of patients who have pathological values... on the grounds that these patients lack DMC" (2009, XX). This seems to leave open the possibility that we may be able to justify compulsory treatment of patients who have pathological values on grounds other than that they lack DMC. As we wrote in our response to the discussants of our original paper, "The primary issue for us is whether the reasons for refusal to which we draw attention provide grounds for overriding refusal, and if they do how they can be characterized in such a way as to avoid the ever-present danger of simply overriding autonomy in a patient's best interests" (Tan et al. 2006b, 300).In deciding on whether to use compulsory treatment, there are other relevant factors that may need to be considered, such as the seriousness of the decision, which determines the threshold for competence. However, in this response we consider three issues. First, we argue that the current concept of DMC is by no means so clear cut or generally agreed upon as Whiting implies, and that some of the lack of clarity relates to pathological values. Second, that the concept of DMC is itself dependent on accounts of autonomy, and that it is plausible that pathological values can affect autonomy. Third, we directly consider the question of whether a coherent account of pathological values might be given based on a concept of authenticity.The Current Criteria for DMCWhiting argues that the current criteria for DMC are correct and that an additional criterion along the lines of absence of pathological values should not be added. This argument assumes that there is a clear and agreed understanding of the current criteria. We believe this is not the case for three reasons.(i) Whiting begins his account of DMC by saying that it is normally taken to include: "(1) [End Page 345] understanding (and appreciation)" (2009, 341). Already there is an area of dispute, and the use of parentheses reflects this. The concept of 'appreciation' was developed by Grisso and Applebaum (Grisso, Appelbaum, and Hill-Fotouhi 1997). It is not included in either English common law development, for example (ReC), nor in the criteria specified in the Mental Capacity Act 2005. More important, Grisso and Appelbaum in their comment on our original paper (2006) argue that our work advances thinking about 'appreciation' rather than requiring that we add new elements. The implication is that they believe that what we have called pathological values are relevant to the assessment of capacity and are already included in an account of capacity that incorporates the criterion of 'appreciation.' In our response, we argued that pathological values are not entirely captured within the account of appreciation that Grisso and Appelbaum had previously given. We do not want to revisit that issue here, but the point of relevance is that on one view (that of Grisso and Appelbaum) pathological values are already included in the current criteria for DMC as part of the concept of appreciation, whereas on Whiting's view they are not.(ii) Even if there were agreement over the wording and concepts relevant to DMC there is a further important issue: how are those concepts... Research demonstrates that women experience disgust more readily and with more intensity than men. The experience of disgust is associated with increased attention to disgust-related stimuli, but no prior study has examined sex differences in attention to disgust facial expressions. We hypothesised that women, compared to men, would demonstrate increased attention to disgust facial expressions. Participants completed an eye tracking task to measure visual attention to emotional facial expressions. Results indicated that women spent more time attending to disgust facial expressions (...) compared to men. Unexpectedly, we found that men spent significantly more time attending to neutral faces compared to women. The findings indicate that women’s increased experience of emotional disgust also extends to attention to disgust facial stimuli. These findings may help to explain sex differences in the experience of disgust and in diagnoses of anxiety disorders in which disgust plays an important role. (shrink)

In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. Theories of consciousness have a long and controversial history. One well-known proposal — integrated information theory — has recently been labeled as ‘pseudoscience’, which has caused a heated open debate. Here we discuss the case and argue that the theory is indeed unscientific because its core claims are untestable even in principle.

In God and Human Freedom: A Kierkegaardian Perspective Tony Kim discusses Søren Kierkegaard’s concept of historical unity between the divine and human without disparaging their absolute distinction. Kim’s central analysis between the relation of God and human freedom in Kierkegaard presents God’s absoluteness as superseding human freedom, intervening at every point of His relation with the world and informing humanity of their existentially passive being. Kim argues Kierkegaard is not a strict voluntarist but deeply acknowledges God’s absoluteness and initiative (...) over and against human life. Moreover, the author’s exploration of unity in Kierkegaard points to the very ethics of who God is, one who loves the world. As a child in Malmesbury, Thomas Hobbes had an opportunity to observe many of the social and political phenomena that he considered in his later work. Contemporary sources reveal that Hobbes lived in a community that was wracked by marked animosity between different social groups, frequent disorder and a lack of consensus about the legitimacy of local political institutions. There was tension between the town’s elite and a proletariat of impoverished workers. Different members of the elite clashed, sometimes violently, as (...) they competed for local ascendancy. Hobbes’s extended family was heavily involved in these events. His hometown was deeply troubled. It was also a place where people had access to some “political” vocabulary which they used when describing their discontents and conflicts. The possible influence of Hobbes’s early experiences on his intellectual development has attracted little previous attention. (shrink)

The book presents the case for the making of a new political imagination by offering a critique of existing political institutions, philosophy and practices that are unable to provide the thinking, means and leadership to deal with the complexity and crises of specific locales and the world at large. The authors make clear that there is a fundamental disjuncture between the complexity of the combined critical conditions that are now putting life on Earth at risk, and the divisions and theories (...) of knowledge that are dominantly and instrumentally trying to understand the situation. In response this work makes the case for the need for a new political imagination that rejects the sufficiency of existing political ideologies (including democracy) being the end point of politics. The book tackles the political underpinnings of social and economic life in a world still embedded in the inequities of the afterlife of colonialism and state socialism. Peirce's career as a logician spanned almost half a century, during which time he produced several increasingly complex sign systems. The best-known, from 1903, defined amongst other things a signifying process involving sign, object and interpretant, the universally-known icon-index-symbol division and a set of 10 distinct classes of signs. Peirce subsequently expanded this process to include 2 objects, the sign and 3 interpretants. Uncoincidentally, in the 5 years between 1903 and the final system of 1908, he introduced a number of (...) highly innovative semiotic concepts which he never developed. One such concept is hypoiconicity, which comprises 3 levels of isomorphism holding between sign and object and, in spite of the mutations these varieties of icon subsequently underwent, offers qualitative analysis as a complement to the traditional literal-figurative binarism in the discussion of verbal and nonverbal signs. Another is semiosis, which Peirce introduced and defined in 1907 but only rarely illustrated. Involving a complex combination of object, perception, interpretation and a medium, this is shown to be a far more complex signifying process than the one implicit in the three-correlate definition of the sign of 1903. Exploring the evolving theoretical background to the emergence of these new concepts and showing how they differ from certain contemporary conceptions of sign, mind and signification, the book proposes an introduction to, and explanations and illustrations of, these important developments. It was most often Engels who had the task of presenting the future society, by commenting and developing the indications by Marx, and then, after the death of this latter, in making corrections of great importance. The aim of the article is to show that Engels did not defend just one single notion of socialism, but several. Inhis mind they corresponded to different stages in the construction of communism. For the period of transition following the coming to power of the (...) proletariat, he envisaged a state controlled market socialism. For the period of socialism, as such, he recommended integral planning, abolishing the market. But later he moved away from this idea and approached an associative socialism, more in tune with the aims of communism: in brief, co-operatives, and a plan of orientation, which correspond to two levels of democracy. Finally, the article presents a certain number of critical commentaries in the light of past history and of current research on models of socialism. (shrink)

Bien que cela transparaisse déjà depuis un bon moment, ce n’est que depuis la récente crise économique que cet état de fait est reconnu de manière plus générale. Cependant, plusieurs initiatives ont étés lancées dans l’espoir d’améliorer la situation. Une initiative phare fut celle qu’a lancée George Soros, à partir du constat suivant: si la réflexivité est une composante majeure de la réalité sociale, les contributions dominantes actuelles en économie (...) n’intègrent pas cette dimension. Le propos de mon article est de montrer que si Soros nous donne un éclairage pertinent, il ne pousse pas assez loin son raisonnement. L’essence de son message risque de se perdre en conséquence de certains propos qu’il faut mettre en doute et qui ne sont peut-être pas nécessaires à son argumentation centrale – des propos que l’on peut retrouver ailleurs dans la quête d’alternatives, et qui méritent à ce titre une attention particulière. Introduction For philosophers, the current phase of the debate with which this volume is concerned can be taken to have begun in 1986, when Jane Heal and Robert Gordon published their seminal papers (Heal, 1986; Gordon, 1986; though see also, for example, Stich, 1981; Dennett, 1981). They raised a dissenting voice against what was becoming a philosophical orthodoxy: that our everyday, or folk, understanding of the mind should be thought of as theoretical. In opposition to this picture, Gordon and (...) Heal argued that we are not theorists but simulators. For psychologists, the debate had begun somewhat earlier when Heider (1958) produced his work on lay psychology; and in more recent times the psychological debate had continued in developmental psychology and in work on animal cognition. This paper presents a case study of a psychiatric intervention as an example of an institutional ethnography of psychiatric work. Institutional ethnography, a mode of inquiry outlined by Dorothy Smith (1987), is conceived here as an approach to the analysis of work in institutions as the contingent, local and context-bound insertion of a particular "case" - a patron, a pupil, a client, a patient - into both institutional and other social (e. g. gender, class) relations. The case presented in this (...) paper, shows how a psychiatric factual account is the outcome of a process of the recognition, and/or the production, of "mentionables," followed by the documentary interpretation of mentionables as symptoms. Subsequently it is demonstrated that, and how, the recognition of mentionables depends on non-professional interpretations which by their nature express other social (such as gender, class, etc.) relations. This description of psychiatric diagnostic work is produced by means of a method of discourse analysis that consists of the juxtaposition of the various institutional texts (the two reports) with the transcript of the interview. An analysis of only the interview data would undoubtedly have resulted in some insights about psychiatric interviewing but would have shown neither how the interview functioned as a stage in the institutional process of (re)writing reports nor how ideological evaluations entered the diagnostic process. On the other hand, an analysis of only the two reports would have resulted in some insights about psychiatric reporting but would not have shown how these reports were produced. (shrink)

Like most terms in social theory, the term "conservative" is profoundly ambiguous and contested. In the United States today the word is often applied to those who call for an absolute minimum of government interference in capitalist markets. In another meaning it refers to those who insist that social life should center on the preservation of a community’s traditions and cultural values. There is a deep tension between these two viewpoints. Capitalist markets left to themselves radically destabilize established communities, and (...) so preserving cultural traditions and values requires political intervention in economic life. Given this ineluctable tension it is probably best not to use the same term to refer to both positions. In the present paper I shall refer to the former perspective, whose intellectual roots are found in the "classical liberalism" of John Locke and others, as "neoliberalism." The latter perspective will be referred to as "neoconservatism.". (shrink)
